General Terms and Conditions
These Terms and Conditions govern your use of the SR CARE website at www.srcare.com.au (“SR CARE Site”), and your relationship with SR CARE (“SR CARE “, “we” or “us”). Please read them carefully as they may affect your rights and obligations under the law. If you do not agree to these Terms and Conditions, please do not use the SR CARE Site. Employers
If you are seeking to instruct SR CARE for the provision of recruitment services, our standard terms and conditions shall apply (copy available upon request).
SR CARE makes no representation or warranty in respect of any of the following:
- the existence or availability of any appointment advertised on the SR CARE Site; or by SR CARE Personnel.
- the final terms and duration of any appointment obtained through the SR CARE Site; or by SR CARE Personnel.
Candidates
When you register as a candidate, or when SR CARE contacts you via telephone or email for a temporary or permanent position, you accept becoming part of an Agreement with SR CARE which comprises participating in recruitment processes and receiving any alert of vacancies that may fit your profile. The rights and obligations entailed by the acceptance of said Agreement are set out in these Terms and Conditions, which you will accept at the time of registration, or when you receive it via email once you confirm your interest in becoming part of our Database. The recruitment services for candidates are free of charge. You can stop being part of this relationship at any time, by contacting us using the contact details described below.
Use of the SR CARE Site
We operate the SR CARE Site to assist you in understanding SR CARE’s services and in communicating with us.
The SR CARE Site is provided for your personal use subject to these Terms and Conditions. If you are unable to access all/part of our site or upload your CV, then please contact us here and we will provide further support.
Amendments
We may update these Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the SR CARE Site. We will notify you of any changes, including (i) the scope of changes, (ii) the objection period, (iii) the fact that non-objection shall be regarded as acceptance and (iv) the consequences of objection. The changes will apply after we have given notice.
Your use of the SR CARE Site
You may not use the SR CARE Site for any of the following purposes:
- disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;
- transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice;
- interfering with any other person’s use or enjoyment of the SR CARE Site; or
- making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
You will be responsible for our losses and costs resulting directly from your breach of this clause.
Applications and enquires
You can apply/enquire on SR CARE Site. This gives you various options such as the possibility of receiving an unlimited number of job alerts, the ability to upload your CVs, etc. If you enquire/apply, you must ensure that the details provided by you on application or at any time are correct and complete.
Please inform us without delay of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.
If SR CARE has reason to believe that there is likely to be a breach of security or misuse of the SR CARE Site, we may suspend/delete all your details from SR CARE.
Right to suspend or cancel your application
We may suspend or cancel your application immediately if you breach any of your obligations under these Terms and Conditions.
You may ask us to delete your application at any time via SR CARE Site. In addition, you may unsubscribe from receiving marketing communications through the by contacting info@srcare.com.au
The suspension or cancellation of your application and your right to use the SR CARE Site shall not affect either party’s statutory rights or liabilities.
Disclaimer
Whilst SR CARE uses reasonable care in compiling and presenting the content found on the SR CARE Site, it is provided purely for information and you should seek further guidance and make independent enquiries before relying upon it. If SR CARE is informed of any inaccuracies in the material on the SR CARE Site, we will attempt to correct the inaccuracies as soon as we reasonably can.
If we are in breach of these Terms and Conditions, we will only be responsible for any losses that you suffer to the extent that they are a foreseeable consequence to both of us, and our liability shall not in any event include business losses such as lost data, lost profits, or business interruption, to the extent permitted by applicable law.
These Terms and Conditions shall not limit or affect our liability in case of gross negligence or wilful misconduct, or if something we do negligently causes death or personal injury.
Availability of the SR CARE Site
We cannot guarantee that the service will be fault-free. If a fault occurs in the service, please report it here and we will attempt to correct the fault as soon as we reasonably can. If SR CARE is informed of any inaccuracies in the material on the SR CARE Site, we will attempt to correct the inaccuracies as soon as we reasonably can.
Your access to the SR CARE Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.
Intellectual Property
All information incorporated within the SR CARE Site is owned or licensed by SR CARE. You may retrieve and display the content of the SR CARE Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the SR CARE Site without written permission from SR CARE.
Equal Opportunities & Diversity
We may also release information relating to you to regulatory or law enforcement authorities, if required to do so. We may use the information we have collected about you on an anonymized basis for the purposes of monitoring in relation to our equal opportunities policy. We also reserve the right to disclose the information we have collected about you to our professional advisers and to other persons to the extent that SR CARE contracts out any aspect of the operation of its recruitment agency services. These third parties will be acting under similar undertakings of confidentiality as SR CARE.

Applicable Law
These terms and conditions will be subject to the laws of NSW, Australia. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement, and you want to take court proceedings, you must do so within NSW, Australia.
Miscellaneous
You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.
If you breach these Terms and Conditions and SR CARE chooses to ignore this, SR CARE will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
SR CARE shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
